SMS Terms and Conditions

National Center for Safety Initiatives, LLC (“NCSI,” “company,” “we,” “us,” or “our”) provides these SMS Terms and Conditions (the “SMS Terms”), which govern the provision and delivery of text messages by us or our text message service providers to you. NCSI provides this text message service to: (1) provide you with information you requested from us, (2) provide updates regarding transactions with or through us, and/or (3) inform you of company products, surveys, or offers that may be of interest to you.

E-SIGN DISCLOSURE:
By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by sending an email to support@ncsisafe.com with “Revoke Electronic Consent” in the subject line. To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (i) a device (such as a computer or mobile phone) with a web browser and Internet access and (ii) either a printer or storage space on such device. For a free paper copy, or to update our records of your contact information, send an email to support@ncsisafe.com with contact information and the address for delivery.

SIGNING UP FOR NCSI TEXT MESSAGES
By agreeing to receive text messages in connection with the Services, including marketing text messages, you agree to these SMS Terms, and NCSI’s Privacy Policy and Terms & Conditions You also agree that NCSI or its agents may use any automated or non-automated technology to send you marketing and/or informational text messages to the mobile phone number associated with your agreement. You understand that you are not required to receive NCSI text messages as a condition of purchasing services or products made available by NCSI.  For purposes of these SMS Terms, “agreeing to,” or “agreement” refers to requesting, joining, opting in, enrolling in, signing up for, acknowledging, providing your phone number, or otherwise consenting to receive any text messages.

COSTS OF SIGNING UP FOR NCSI TEXT MESSAGES
NCSI does not charge you for its text message program. But message data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

FREQUENCY OF TEXT MESSAGES
We may send you an initial message confirming that we have received your agreement to receive text messages. After that, the specific amount of text messages may vary depending on how you use our services and the types of text messages you registered to receive. The number of text messages you receive may depend upon factors including how you use our services and whether you take steps to generate additional text messages from us (such as by sending a HELP request).

PARTICIPATING CARRIERS
Content is not available on all carriers and carrier participation could change. As of July 18, 2018, our text messages can be sent through most carriers. The content is not compatible with all mobile device models. The list of participating carriers may be changed at NCSI’s sole discretion without prior notice. NCSI and the mobile carriers (such as T-Mobile) will not be liable for any delays in the receipt of any SMS messages or changes to the participating carriers as delivery is subject to effective transmission from your carrier with active participation at that time.

ELIGIBILITY
By agreeing to receive NCSI’s text messages, you represent that you are 18 years of age or older and understand the obligations and agree to the terms set forth in these SMS Terms and the NCSI Terms & Conditions all of which form binding agreements between you and us. You further represent that you are the subscriber of the cellular service at the mobile number provided or that you are authorized by the subscriber to sign-up for texts. We may terminate our text message programs or your participation in them at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received, but these SMS Terms still will apply.

OPTING OUT OF NCSI TEXT MESSAGES
If you no longer want to receive NCSI text messages, you must text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message from NCSI. You agree that texting STOP, END, CANCEL, UNSUBSCRIBE, or QUIT in response to our text message is the only reasonable method of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than STOP, END, CANCEL, UNSUBSCRIBE, or QUIT or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out. You must separately opt out of each number from which you have agreed to receive NCSI text messages. After unsubscribing, we may send you confirmation of your opt-out via text message. If you have revoked consent and want to re-enroll in our text message program, you can resume your enrollment by agreeing to receive text messages again through the applicable enrollment mechanism.

DISCONTINUING OR TRANSFERRING YOUR PHONE NUMBER
If at any time you intend to stop using the mobile telephone number that has been used to subscribe to text messaging, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the user opt out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these SMS Terms. You further agree that, if you discontinue the use of your mobile telephone number without notifying us of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by us, or any party that assists in the delivery of the mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your account or these SMS Terms.

YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM US ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.

MODIFICATIONS TO THESE SMS TERMS
We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your continued enrollment in the NCSI text messaging program shall be deemed to constitute acceptance by you of such modifications, additions or deletions.
